Business Leases are wholly different from residential Leases and are governed by the Landlord and Tenant Act 1954 (“the Act”). Getting Leases right is important for both Landlords and Tenants as the Act does contain provisions that enable a Tenant to obtain a degree of security of tenure. When acting for Landlords the issue of whether the Lease should be contracted out of the Act is important and since June 2004 is more straightforward than it was in the past. When acting for Tenants it is important to ensure that the covenants with regard to maintenance, repair and dilapidations at the end of the Lease are got right and Tenants need detailed advice on these issues. A Lease can be an asset but it can also be a liability for both Landlord and Tenant and a personal service is required to give appropriate advice and for Landlords or Tenants to make informed decisions as to the best way forward for them.
